The Utah Insurance Department issued a bulletin on title licensees’ questions regarding Rule R592-6, Unfair Inducements and Marketing Practices in Obtaining Title Insurance Business.
The bulletin states, “The Utah Insurance Department regularly receives questions from title licensees about the meaning and application of Utah Admin. Code R592-6, Unfair Inducements and Marketing Practices in Obtaining Title Insurance Business. Because the Title and Escrow Commission’s (TEC) role includes ‘advis[ing] the commissioner of the most critical matters affecting the title insurance industry,’ those questions will be answered in the future by the TEC. See Utah Code § 31A-2-404(2)(f).”
Licensees may submit questions via email to [email protected]. The department will redact personal identifiers from the email, then forward the question to the TEC for discussion and response at its next monthly meeting. The bulletin encouraged those who submitted questions to attend the meeting in person or virtually to participate in the discussion.
After the meeting, the TEC will draft a response to the question and forward it to [email protected]. The department will then send the response to the questioner. A record of the questions and responses will be posted on the department’s website, https://insurance.utah.gov/licensees/title/tec/.
The bulletin noted that responses from the TEC are advisory and not legal advice, nor are they binding on the TEC, the department or the insurance commissioner.
